Ready or Not: What You Need to Know About CA’s New Ammo Registration Scheme

When July 1, 2019 rolls around, there are going to be a lot of people caught unaware when they find out they have to provide everything but their firstborn kid when buying ammunition.

Sad but true – ammo registration is right around the corner and a lot of unsuspecting folks are going to be mighty angry when they head to Walmart to buy a single box of shells.  Regulations were just released by the Department of Justice and as usual, they took their sweet time – moving slower than molasses in releasing the final product.  Gun dealers have been on pins and needles waiting to see to what degree DOJ was going to, uh, screw them.

The background check process is the most significant problem by far and shows they are simply not able to follow the law.  Current California law mandates the background check to be completed instantly.  Given this requirement, why then would DOJ regulations issue “Ammunition Transaction Numbers” allowing purchasers to “monitor the status” of the background check? IF BACKGROUND CHECKS ARE REQUIRED TO BE INSTANT, WHY WOULD ANYONE NEED TO “MONITOR THE STATUS” OF ANYTHING?  Once again, the Department placing themselves above what is legally required.

Obviously, the collection of personal data is equally as contemptible.  Things are pretty darn rotten when voting requires NO ID whatsoever but buying ammo requires a “licensed vendor” to collect data on:

  • The date of the sale/transfer;
  • The purchaser’s driver’s license or other identification number and the state in which it was issued***;
  • The brand, type, and amount of ammunition sold or otherwise transferred;
  • The purchaser’s full name and signature;
  • The name of the salesperson who processed the transaction;
  • The purchaser’s full residential address and telephone number;
  • The purchaser’s date of birth.

If that’s not bad enough, the Department is also illegally requiring citizenship status – from legal non-residents.  This is rich – DOJ wants those with legal residency in the United States to document the origin of their citizenship while California wants to expand free medical coverage to those who are in this country illegally.

Thank goodness a lawsuit** has been filed that very effectively challenges this garbage, because before it even begins, ammo registration is a big cluster.  The Department has already indicated that they are not capable of complying with current law.  What an example for the people of California…

***ADDENDUM: There is NOTHING in statute or regulations issued by the Department of Justice that requires a REAL ID for the purchase of ammunition beginning July 1, 2019.       As the blog states, the regulations were just released and don’t go into effect until July 1, 2019. This is a convoluted issue (statute v regulations v initiative language) and our attorneys are carefully evaluating the most judicious steps to take.       A lawsuit has already been filed. It’s called Rhode v Becerra. I’ll tell you what we’ve been doing, we have been working with our attorneys to plan for the wisest next step. This is VERY convoluted and we have one chance to make the right move. That is what we are working on.

        The Bill of Rights restricts states as it does the Feds. Supreme Court has ruled in previous cases that restrictions on ammunition availability is an infringement of the ownership of a firearm.

        States rights are restricted by Federal Law and the states are able only to assume unaddressed rights that are not granted the Federal government.

        There are already full background checks on the purchase of firearms. NRA members see no reason for more. What we NRA members want is actual enforcement of existing law. Not a bunch of new ones. One specifically is that Convicted Felons who attempt to buy firearms are breaking the law, but are not being arrested. When felons are caught by the existing background check when attempting to buy a gun, that attempt is violation of the law and must be reported by the Dealer. The Feds are ignoring those reports and no actions are being taken!

        Driving is a privilege, not a right. Registering an automobile is licensing it to be operated on publicly-funded roadways, which may or may not include a portion of the vehicle registration. You can freely operate a motor vehicle on your own property without this registration, as you maintain the ‘roadway’ privately. Firearm registration and automobile registration are apples & oranges. That being said the amount we pay to register autos in CA is obscene (IMO).

    the law was set up for gun stores , not gun shows , I belive the back ground check is for calif. not out of state . no calif. d.l. can not buy ammo. doj still has not provided a phone number to do back ground checks on weekends for gun show venders who do not have computers to do back ground checks.

      The law prohibits importing ammo without going through a liscenced dealer. So theoretically the fact that going out of state and bringing it back could potentially result in a weapons violation which could potentially lead to felony convictions this striping one of the right to have the guns inthe first place.
      Of course this is all based on the notion that “law abiding” folks will follow the law.

Also another problem with this law on this subject… What if I go to another state with no ammo, purchase it there to do some shooting/hunting. Then before I return I forget to dispose of all the ammo I legally purchased and innocently bring a few rounds of ammunition back. I’ve just unwittingly broken the law. The law should not be a trap to make lawful citizens criminals.

      My friend and I have filled out paperwork declaring ourselves a two person militia. Also in our documentation is a provision magazines holding over 10 rounds are legal for semi-automatic firearms. A sub clause states injuring or killing of innocent civilians will remove our right to own firearms and subject us to the death penalty.

    Jeff….The 2nd amendment says that the right to keep and bear arms SHALL NOT BE INFRINGED.
    Criminals don’t and won’t follow any of these laws, and making it more difficult for those who DO wish to follow the laws, i.e, the Good Guys, to have protection from those who are mentally ill and evil who would shoot innocents, only makes it easier for them to do so.

    These regulations mandate that even law enforcement must have a letter from their agency head to purchase ammo, which expires per these regulations in 30 days…but PC 30312 contains exemptions for online purchases by LE, only in criminalfornia does this make sense lmao.

      If found returning to CA with ammo, you will be arrested. Good luck proving that the receipt you have actually pertains to the ammo in your possession when your arrested. Which doesn’t matter anyway the way the law is written.
      Not to mention the thousands in legal costs you will incur.

    FYI: If you don’t have a California Real ID by July 1st. You will need to bring a legal copy of your birth certificate. Which the store will then copy. I’m sure no one wants their birth certificate floating around. A regular Cal Driver’s Licence doesn’t cut it anymore to buy guns and ammo

    Most suppliers in Oregon have told me they don’t care what state you’re from they will sell you ammo. This law will create a huge black market and the state will lose out on tax money. It’s time for the SCOTUS to break it’s silence and speak up.

    People have been bringing illegal fireworks into the state since forever. There is quite a black market for them. What does it sound like in your neighborhood when it’s close to July 4th? It has become nearly impossible to prevent them coming here. I foresee the same thing happening with ammo. You might have to pay a buck or two more per box, but it will be there. Liberal politicians are so damn ignorant.

    This law is unconstitutional.
    That being said, a Law Enforcement Officer has to have probable cause to search a person’s automobile.
    If you’re bringing in ammunition from out of State, just keep it out of plain sight, and if they ask to search your car, politely tell them “no thank you.”

    I can recall having to sign a log book every time I purchased ammo in California. Eventually the requirement was tossed out as being costly and ineffective. Effectiveness is obviously not a requirement any longer.

    It remarkable that Prop 63 only applies to CA residents. As such Mr. Newsom’s legacy legislation does not apply to non residents. Essentially a non resident is still legally able to bring in as much ammo as they want into California. Hypothetically non residents can purchase as much ammo in Nevada, import into California and once in the golden state………legally give it away to family or friends, they just cant sell it.

    Pretty interesting that Prop 63 gives non residents have more immunity in the golden state than her own residents. Makes you wonder who exactly voted for Prop 63?

    This is also a forced gun registration. Say Bob Jones has an older pistol he inherited from his late dad 15 years ago. Still in dads name. With the new ammo law Bob can’t buy ammo for the gun unless he registers it in his name now. State wants to know what every law abiding citizen has so if in the future they wish to confiscate they now what and where they are.

    So now in order to put teeth into this law, if you drive into California with more than a certain amount of ammo, you must REGISTER that ammo or you will be breaking the law. That’s right – you cannot freely bring ammo into the state of California. If they allowed that, then you would have the same situation as the cigarette tax laws. People smuggle cigarettes from Virginia into New York and sell them on the street as “singles” free of tax. 30% in VA (lowest in US) vs 435% in NY (highest). A pack of cigarettes is $12.85 in NY vs $5.43 in VA.

    I just came back from Walmart after attempting to purchase two b”oxes of ammo. I was informed by the clerk that I needed a “New I.D. ” to purchase ammo.

    She explained and showed me the requirement stating my license had to have the bear in the right corner. I am retired law enforcement and a legal citizen of the United States.

    So now I have to pay for a new drivers license even though I have a year and a half before it expires.

      Hi Bill….it sounds like you are being required to apply for ‘Real ID’. We’ll have to have it by Oct/2020 to fly even domestically I understand. I am surprised that your current license is not being recognized until the law takes effect. This concerns me a great deal. I hope it concerns others, too. I wonder what could be coming next to hinder honest living, law abiding citizens to move freely and enjoy the benefits of being good, responsible citizens? Requiring you to present a ‘Real ID’ instead of honoring your current DL is unbelievable. Getting a “Real ID’ requires much more proof of who you are (personal documents) and a little more money. That seems to be the scenario with most of this…more money. If a background check isn’t good enough, where does the intrusion stop?

    I am a female gun owner. I would never consider hiding or retreating into a deeper part of my home to avoid an intruder. I firmly believe my home is off limits to prowlers and those who are up to no good or intend to do harm to me or mine. My philosophy is you are welcome in my home when invited. Anyone who is bold enough to force their way in uninvited and pose a threat, you are likely not leaving in he same condition as you entered. Unless you agree to turn around and exit immediately. I have a right to protect myself and to react if I believe I am in harms way. Target shooting is my hobby and I am opposed to killing anything living. Unless it poses a life altering threat to me. If that be the case I prefer to be judged by twelve rather than carried by six. That’s my law in my home.
    I am also not opposed to a background check to buy a firearm. I have nothing to hide, I have complete control of my faculties and I hope this helps with selling firearms to those who do not have any business having one. We know that it won’t be 100% effective but I am all for allowing it if it is proven to work. We do walk a fine line in never allowing our 2A rights to be trampled. It’s very sad we even have to have discussions about it. We know we have to register our guns, our cars, our children in school, etc. I hope that all gun owners are responsible people and the vast majority are! I do not want my rights as a law abiding person to be crippled to give false comfort to those who don’t like guns and who are not focusing their ‘know it all’ attention to the real problem…criminals and mentally impaired. Anytime the government wants to control they look to punishing law abiding citizens. We’re the easiest target. We obey whereas problem people don’t. And they won’t, no matter how many restrictions are placed on law abiding citizens who follow our constitutional rights. A law abiding citizen should never have to give up their rights because of the crimes of criminals or mentally ill. As long as I am legal to vote I will be legal to buy and own a gun. When you make owning a gun a crime you make criminals out of good people.

    This ammunition law, when first implemented, had an unintended consequence. California decided to use their Automated Firearm System (AFS) as a shortcut to check the purchaser. An AFS record is generated when you buy a gun and go thru the State mandated background check. So, if you are in the system you have successfully gone thru at least one background check.

    However, if you had not bought a firearm since 2016 merchants would not sell you any ammo, in the State’s wisdom they would not accept AFS entries prior to 2016. The remedy was to buy a gun, that would get your info into AFS and viola – now you can buy ammo! Gun control legislation that actually REQUIRES you buy a gun?! Only the Democrats could come up with something so ridiculous and useless.

    Typical of CA politics, the urge to do something, anything, even if the legislation is written by a gaggle of congenital idiots who can’t read a flow chart. As a result an already banner year for gun sales is setting a new record. Sad part is that this is typical of Newsome’s performance as governor and why there is a recall effort afoot.
